March 1, 2019The Puerto Rico Energy Bureau (“Energy Bureau”), pursuant Act 57-2014, as amended, known as the Puerto Rico Energy Transformation and RELIEF Act and Act 38-2017, known as the Uniform Administrative Procedures Act of the Government of Puerto Rico, proposes to amend Regulation No. 8863, Regulation on the Procedure for Bill Review and Suspension of Electric Service Due to Failure to Pay. Regulation 8863 is proposed to be amended to establish that all requests for review of final decisions of Electric Service Companies where the amount objected is equal or less than five thousand dollars ($5,000.00), will be met following the summary procedure established in the Regulation. Likewise, Regulation 8863 is proposed to be amended to provide that when the amount objected is greater than five thousand dollars ($5,000.00), the Client will have the option to request that the matter be dealt with following the summary procedure, instead of resorting to the formal review procedure established in the Regulation.
Regulation 8863 is proposed to be amended to state that the Puerto Rico Energy Bureau is the agency with the jurisdiction to review final decisions of the Electric Service Companies regarding bill objection procedures, under the Reorganization Plan of the Public Service Regulatory Board of Puerto Rico and Act 211-2018.
The text of the amendment proposal to the Regulation is available for public scrutiny at the Puerto Rico Energy Bureau’s Clerk Office, in the World Plaza Building, 268 Muñoz Rivera Ave., Plaza Level Suite 202, Hato Rey, PR 00918. The working hours of the Puerto Rico Energy Bureau are between 8:30 a.m. and 12:00 m. and from 1:00 p.m. to 5:00 p.m., on business days. The amendment proposal will also be published along this Notice on the Energy Bureau’s Internet website, www.energia.pr.gov.
During thirty (30) days, starting from the publication date of this Notice, any interested person shall be able to submit comments in writing or request an oral hearing about the Regulation. When requesting an oral hearing, the petition shall include the justifications to grant such hearing.
