Notice About Proposed Regulation of Renewable Energy Certificates and Compliance with the Puerto Rico Renewable Portfolio Standard

The Energy Bureau of the Public Service Regulatory Board of Puerto Rico (“Energy Bureau”), under Act 57-2014, as amended, known as the Puerto Rico Energy Transformation and RELIEF Act, Act No. 82-2010, as amended, known as the Public Policy Act on Energy Diversification through Sustainable and Alternative Renewable Energy in Puerto Rico, and Act 38-2017, as amended, known as the Uniform Administrative Procedure Law of the Government of Puerto Rico, proposes to adopt the REGULATION ON RENEWABLE ENERGY CERTIFICATES AND COMPLIANCE WITH THE RENEWABLE ENERGY PORTFOLIO OF PUERTO RICO (“Proposed Regulation”).
On October 21, 2021, the Energy Bureau began an informal process with public participation, through In re: Regulation of the Renewable Energy Certificate Market and Compliance with the Puerto Rico Renewable Energy Portfolio, Case No. NEPR-MI-2021 -0011, to obtain comments from interested persons or groups to prepare a proposal for a Renewable Energy Certificate Regulation. After having completed this process, the Energy Bureau begins the formal regulation adoption process required under Act 38-2017.
The Energy Bureau intends to adopt the Proposed Regulations to monitor compliance with the Renewable Energy Portfolio and establish the regulatory provisions that apply to Renewable Energy Certificates, establishing a stable and predictable regulatory framework, with the ability to promote and convert the generation of renewable energy into a viable activity and facilitate the compliance of Retail Energy Suppliers with the Renewable Energy Portfolio, as established in Act No. 82-2010.
The Proposed Regulations (English and Spanish versions) will also be published in conjunction with this notice in the regulations section of the Energy Bureau’s website, www.energia.pr.gov. Additionally, a hard copy (English and Spanish versions) of the Proposed Regulations is available for public scrutiny at the Energy Bureau Clerk’s Office, located at the World Plaza Building, 268 Muñoz Rivera Ave., Plaza Suite 202 Level, San Juan, PR 00918. The Energy Bureau’s office hours are from 7:30 a.m. to 7:30 p.m. to 12:00 p.m. and from 1:00 p.m. to 4:30 p.m., on weekdays.
The period to request in writing a duly substantiated oral hearing or comments on the Proposed Regulation ends thirty (30) days from the date of publication of this notice. Any interested person may submit written comments related to the Proposal for Approval of said Regulation. Comments must be directed to the attention of Edison Avilés Deliz, President, and must include the following description in their title: “Comments on the Regulation on Renewable Energy Certificates and Compliance with the Puerto Rico Renewable Energy Portfolio – Case No. NEPR-MI-2021-0011”, must include the name and postal address of the person or entity submitting the comments and a telephone number to which the Energy Bureau staff can contact in case they deem it necessary to clarify any information regarding the content of the comments or any situation occurs that has interrupted their receipt. Comments must be submitted (i) by email to: comments@jrsp.pr.gov; (ii) through the electronic filing tool of the Energy Bureau: https://radicacion.energia.pr.gov/; (iii) by mail to the postal address addressed to the Energy Bureau’s Office Clerk, World Plaza Building, 268 Ave. Muñoz Rivera, Nivel Plaza Suite 202, Hato Rey, PR 00918; or (iv) in person at the Clerk’s Office located at the aforementioned address. The Energy Bureau has scheduled a hybrid public hearing for July 10, 2024 at 10:00 a.m., in which the public will be able to present and express their oral comments on the Proposed Regulation. Those interested in participating in the public hearing must, at least one day before the date of the Public Hearing, request an appointment by telephone, contacting the Energy Bureau’s Clerk at (787) 523-6262; or by email, to secretaria@jrsp.pr.gov. The staff of the Energy Bureau Clerk’s Office will send the applicant an email to confirm the reservation of the appointment to depose. If the person is going to participate remotely, the staff of the Energy Bureau Clerk’s Office will send the applicant, the day before the Public Hearing, an email that will contain the link to the Teams platform and the necessary instructions to connect remotely. Appearance at the public hearing will be governed by the Public Policy on Receipt and Handling of Comments and Appearance at Public Hearings, established in Case NEPR-MI-2021-0010.
