The Energy Bureau of the Puerto Rico Public Service Regulatory Board (“Energy Bureau”), proposes to adopt the Regulation for Performance Incentive Mechanisms, pursuant Act 17-2019, known as the Puerto Rico Energy Public Policy Act, Act 57-2014, as amended, known as the Puerto Rico Energy Transformation and RELIEF Act and Act 38-2017, as amended, known as the Uniform Administrative Procedures Act of the Government of Puerto Rico.
The purpose of the Proposed Regulation is to establish the metrics reporting requirements for all eligible Electric Power Service Companies. Furthermore, the Proposed Regulation outlines the process to establish metrics, targets and financial incentives per type of company and/or per company. Through the aforementioned process, the Energy Bureau will determine which incentive mechanisms are needed to induce performance that is consistent with the public interest and the energy public policy. The Proposed Regulation shall apply to all Electric Power Service Companies, excluding Electric Cooperatives. The Energy Bureau may determine, at its discretion, which entity or entities are exempt from these provisions.
The text of the Proposed Regulation is available for public scrutiny at the Energy Bureau’s Clerk Office, located at the World Plaza Building, 268 Muñoz Rivera Ave., Plaza Level Suite 202, San Juan, PR 00918. The working hours of the Energy Bureau are between 8:30 a.m. and 12:00 m. and from 1:00 p.m. to 5:00 p.m., on business days. The Proposed Regulation will also be published along this Notice, on the Energy Bureau’s Internet website, www.energia.pr.gov (here).
Any interested person can submit written comments regarding the proposed Regulation, within thirty (30) days from the publication date of this Notice. Any person interested in submitting replies to comments filed within the aforementioned period shall do so within ten (10) days following the close of the general commenting period, using the means identified above.
The Energy Bureau will hold a public hearing on September 25, 2019, at 10:00 a.m., at its Hearing Room located at World Plaza Building, 268 Muñoz Rivera Ave., Eight Floor, San Juan, Puerto Rico. Any person interested in participating in the process may appear at the public hearing.
