December 16, 2020The Energy Bureau of the Puerto Rico Public Service Regulatory Board (“Energy Bureau”), pursuant Act 57-2014, as amended, known as the Puerto Rico Energy Transformation and RELIEF Act, Act 17-2019, known as the Puerto Rico Energy Public Policy Act and Act 38-2017, as amended, known as the Uniform Administrative Procedures Act of the Government of Puerto Rico, proposes to adopt the Regulation for the Evaluation and Approval of Agreements between Electric Service Companies (“Regulation”).
The purpose of this Regulation is to carry out the legislative mandate to ensure that power purchase agreements between electric service companies are in the public interest and consistent with the policy objectives as set forth by the legislature. The Regulation further follows the specific directives of the legislature regarding power purchase agreements by requiring the Energy Bureau’s review of the financial and technical ability, among other qualifications, of the electric power service companies to provide the contracted services at just and reasonable rates. By approving the power purchase agreements, the Energy Bureau seeks to ensure that the electric power service company has the capability of providing the capacity required under the agreement, reliably, safely, efficiently and at a reasonable rate, consistent with the public interest.
The text of the Regulation is available for public scrutiny at the Energy Bureau’s Clerk Office, located at the World Plaza Building, 268 Muñoz Rivera Ave., Plaza Level Suite 202, San Juan, PR 00918. The working hours of the Energy Bureau are between 8:30 a.m. and 12:00 m. and from 1:00 p.m. to 5:00 p.m., on business days. The Revised Proposal will also be published along this Notice on the Energy Bureau’s Internet website, www.energia.pr.gov.
During a thirty (30) day period, starting from the publication date of this Notice, any interested person shall be able to submit comments in writing about the proposed Regulation.
