August 20, 2018The Puerto Rico Energy Commission, pursuant to Act No. 57-2014, as amended, known as the Puerto Rico Energy Transformation and RELIEF Act, of Act 143-2018, known as the Just, Reasonable and Transparent Billing of Essential Public Services Act; of Articles 2 and 3 of Act 3-2018; of Section 6 of Act No. 83 of May 2, 1941, as amended, known as the Puerto Rico Electric Power Authority Act; and pursuant to Act 38-2017, known as the Uniform Administrative Procedure Act of the Government of Puerto Rico, has adopted the Regulation on the Procedure for the Review of Bills issued by the Puerto Rico Electric Power Authority during Emergency Situations. This Regulation took effect on the date of its approval by virtue of Article 6 of Act 143-2018 and Section 2.13 of Act 38-2017.
This Regulation has the purpose of establishing the norms that will govern the mechanisms and procedures that the Puerto Rico Electric Power Authority will make available to its clients for the purpose of overseeing and resolving disputes that arise in relation to the bills issued during an emergency situation and that contain periods of time in which PREPA did not provide electric service. Similarly, this Regulation will apply in cases in which the client used a source of generation whose production was measured by the client’s meter but that was not a product of the generation and distribution of PREPA. Also, it establishes the procedure for the objection of the aforementioned bills before PREPA and the procedures for the review of any final decision of PREPA by the Energy Commission. Lastly, and for the benefit of the general public, Regulations 9009 and 9018 are repealed and the provisions of Act 143-2018 and Act 3-2018 are tempered in a single regulatory body to provide greater certainty as to the obligations, rights and responsibilities of each party.
The text of the Regulation is available for public scrutiny at the Puerto Rico Energy Commission, located in the Seaborne Building, 268 Muñoz Rivera Ave., Plaza Level Suite 202, Hato Rey, PR 00918. The working hours of the Puerto Rico Energy Commission are between 8:30 a.m. and 12:00 m. and from 1:00 p.m. to 5:00 p.m., on business days. The Regulation will also be published along this Notice on the Commission’s Internet website, www.energia.pr.gov.
During a period of thirty (30) days, starting from the publication date of this Notice, any interested person shall be able to submit comments in writing or request an oral hearing concerning the aforementioned Regulation. In such cases, the petition shall include the justifications for an oral hearing.
